PCT National Phase

Timely, compliant entry into the Korean national phase of your PCT application — deadlines docketed to the day, translations prepared to MOIP standard, and examination requested on your instruction.

Overview

Entering Korea from an international (PCT) application is a strict, deadline-driven procedure. We manage the 31-month national-phase entry window from the priority date, prepare the required Korean translation, file the entry, and handle the request for examination and subsequent prosecution before MOIP.

We act as your Korean counsel of record: verifying bibliographic data against WIPO and EPO records, confirming applicant and inventor details, and flagging any formality gaps before they become office actions. You keep control of every substantive decision; we carry the local procedure.

What we handle

Timely, compliant entry into the Korean national phase — with EPO/WIPO bibliographic data verified before filing.

31-month deadline management

We docket the national-phase entry deadline — 31 months from the earliest priority date — and monitor it against the international file to ensure entry into Korea is never missed.

Korean translation & entry filing

We prepare a complete Korean translation of the specification, claims, drawings and abstract, and file the national-phase entry with MOIP with the correct applicant and priority particulars.

Request for examination

We file the request for examination within the statutory period and advise on timing strategy, since examination does not begin in Korea until it is requested.

Bibliographic & formality verification

We cross-check applicant, inventor, priority and title data against WIPO and EPO records and resolve formality issues at entry to avoid avoidable objections.

How we work

Four steps, one point of contact.

1

Docket & deadline check

We confirm the priority date, international filing date and 31-month deadline, and verify bibliographic data against WIPO/EPO before any work begins.

2

Translation

We prepare and quality-check the Korean translation of the specification and claims, harmonising terminology and reviewing claim scope for local practice.

3

National-phase entry filing

We file the entry with MOIP within the 31-month window, submit priority and applicant particulars, and file any preliminary amendment you instruct.

4

Examination request & prosecution

We file the request for examination and manage the subsequent prosecution — office actions, amendments and arguments — through to grant.

Key facts

31-month entry deadline

National-phase entry into Korea is due within 31 months of the earliest priority date; this deadline governs the entire schedule.

Korean translation required

A Korean translation of the application must be filed to complete national-phase entry; the translation defines the text examined and enforced in Korea.

3-year examination request

A request for examination must be filed within 3 years of the international filing date; without it, examination is not initiated and the application is deemed withdrawn.

Restoration & late entry

Where an entry or examination deadline is missed, limited restoration or late-entry relief may be available under specific conditions — assessed case by case and never assumed.

Common questions

What is the deadline to enter the Korean national phase?

31 months from the earliest priority date. We recommend instructing us well in advance so translation and formality checks can be completed comfortably before the deadline.

Is a Korean translation mandatory at entry?

Yes. A Korean translation of the specification, claims and abstract is required to perfect national-phase entry, and it is the text MOIP examines.

Do you need a Power of Attorney to file?

A power of attorney is generally required for our appointment; entry can typically be filed and the POA submitted within the permitted period. We will confirm the exact requirement for your case.

Can we amend the claims on entry?

Yes. A preliminary amendment may be filed on or after national-phase entry — for example to adapt the claims to Korean practice or to the examination you intend to request.
